If you are stopped for a DUI, know your rights.

  1. While you must submit to blood, breath, or urine tests conducted at a certified testing facility or risk losing you driver’s license, you DO NOT have to submit to a field sobriety test or a PBT or portable breath test submitted on the side of the road.  Politely tell the Officer that you will not submit to roadside tests or exams.
  2. Field sobriety tests are really field drunk tests.  Studies indicate that 46% of sober individuals fail these tests.
  3. Officers do not have the right to search your car.  You can say NO to a request to search or a request to answer questions.  Politely refuse these requests.  Is your right to do so.
  4. If you refuse testing at a certified facility than you may lose your drivers license and you may still be charged with DUI.  The decision is yours but know the possible consequences.
